Ijara: leasing assets under Islamic rules
Islamic leasing, or ijara, is a contract in which a financier buys an asset and rents its use to a customer for an agreed period and rent, keeping ownership risk, with an optional separate promise to transfer ownership at the end.

Two forms of ijara in practice
Operating ijara resembles a conventional operating lease: the asset returns to the lessor at the end, as with many vehicle or equipment rental deals. Ijara muntahia bittamleek, also called ijara wa iqtina, ends with transfer of ownership through a gift or sale promised in a separate document.
Ijara is used for cars, aircraft, ships, machinery, medical equipment and property. It also underpins the most common sukuk structure, in which investors own leased assets and receive rent as their return.
How rent replaces interest
The lessor earns rent for the use of an asset it owns, which Sharia permits because the lessor bears ownership risk. Rent can be fixed or periodically reset against a benchmark, provided the formula is agreed in advance and the asset remains usable.
Sharia conditions for a valid lease
AAOIFI Shari’ah Standard No. 9 requires the lessor to own the asset before leasing it, to bear major maintenance and total loss, and to insure it, ideally through takaful. Rent cannot be charged for periods when the asset is unusable through no fault of the lessee.
How leasing is regulated and taxed
Regulators usually classify ijara by its economic substance. In the UK, consumer ijara car finance is regulated under the Consumer Credit Act 1974 like hire purchase, and HMRC alternative finance rules align tax treatment. Accounting standards such as IFRS 16 or AAOIFI FAS 32 then determine balance-sheet treatment.
VAT or sales tax normally applies to rentals as for any lease. In some countries a second sale at the end of a lease-to-own deal could trigger extra transfer tax, which tax-neutrality rules or careful structuring avoid.
Where ijara finance is available
Ijara is the most widely available Islamic product. Gulf banks use it for cars and homes, Malaysian banks for vehicle financing-i, and Pakistani banks for car ijarah. In the UK, Ayan offers ijara wa iqtina car finance; in the US, UIF Corporation finances vehicles and lease buyouts.
Supervisors of leasing companies
Banks offering ijara are supervised by their central bank. Specialist non-bank lessors are supervised by consumer credit regulators, such as the FCA in the UK. Commercial leasing between companies is often lightly regulated, so contract terms matter even more.
Gaps in the market
Outside Muslim-majority markets, true Islamic equipment leasing for SMEs is limited. Some companies use conventional operating leases, which have no interest component in form, after checking late-payment and insurance clauses with a scholar.
Arranging an ijara: the process
The steps below describe a vehicle or equipment ijara, the most common case. Property ijara adds valuation, conveyancing and land registration stages that depend on local law and can lengthen the timeline.
- Choose the asset and obtain a quote from the supplier or dealer.
- Apply to the Islamic lessor with income or business documents.
- Receive approval and review the lease, maintenance and purchase-promise documents.
- Pay any advance rental or security deposit agreed in the contract.
- The lessor buys the asset and delivers it to you under the lease.
- Pay monthly rent and follow the agreed maintenance and insurance rules.
- At the end, return the asset or take ownership through the separate sale or gift.
Costs and documents in a typical lease
Costs differ between operating and lease-to-own structures and between consumer and business deals. The table lists the categories every lessee should check, without quoting rates, which vary by provider, asset and credit profile.
| Item | What to expect | Note |
|---|---|---|
| Advance rental | Upfront payment reducing later rentals | Not a loan deposit |
| Monthly rental | Fixed or reset against a benchmark | Check the reset formula |
| Insurance or takaful | Lessor insures, cost often included | Comprehensive cover sometimes required from lessee |
| End-of-lease transfer | Nominal sale price or gift | Must be in a separate document |
| Documents | ID, proof of address, income or accounts | Business: company documents |
Mistakes to avoid
Most problems with ijara arise from misunderstanding who owns the asset and who pays for what, so the maintenance, insurance and end-of-term clauses deserve as much attention as the monthly rental.
- Treating ijara like a loan and ignoring the lessor’s ownership obligations.
- Signing a contract where the purchase promise is merged with the lease.
- Overlooking mileage or usage limits in operating ijara.
- Assuming the lessee bears total loss; under ijara the lessor should.
- Forgetting to check early termination costs before signing.
Ijara versus hire purchase
Conventional hire purchase charges interest on credit and transfers ownership automatically after the last payment. Ijara charges rent for use, keeps ownership risk with the lessor and transfers ownership only by a separate act, which changes who bears loss and maintenance during the term.
Using ijara for business equipment
Companies lease machinery, vehicles and IT equipment under ijara to preserve cash and match payments to income. Rentals are generally deductible business expenses, and the structure avoids interest without requiring the firm to buy the asset outright at the start.
Questions about Islamic leasing
The answers below cover common questions about ijara from consumers and businesses comparing it with conventional leasing, hire purchase and personal contract purchase arrangements.
Who pays for repairs under ijara?
Under Sharia rules the lessor bears major maintenance and structural repairs, while the lessee handles ordinary upkeep and damage caused by misuse. Contracts often allocate routine servicing to the lessee, which scholars accept if clearly agreed.
Can the rent change during the lease?
Yes, if the contract sets a clear formula, such as periodic reset against a benchmark with caps or floors. Rent cannot be changed unilaterally or retroactively, and it cannot increase because of late payment.
What happens if the car is written off?
Because the lessor owns the asset, it bears total loss, normally covered by its insurance or takaful. The lease ends and the lessee is not liable for future rent, except where loss resulted from negligence.
Is ijara available for property?
Yes. Many UK home purchase plans and Gulf home finance products use ijara, sometimes combined with diminishing musharaka. The customer rents the home and gradually acquires it, with title passing once the agreed payments are completed.
