Leasing a Car the Halal Way in Germany: What Is Actually Possible

Germany has no dedicated Islamic car leasing for private customers, so Muslims compare conventional leasing forms with ijara principles, consider all-inclusive car subscriptions as the closest rental model, or switch to KT Bank AG’s markup-based vehicle purchase as the Sharia-compliant route to a car.

Leasing a Car the Halal Way in Germany: What Is Actually Possible

What would a Sharia-compliant car lease look like?

An ijara is a rental of usufruct: the lessor owns the car and charges a known rent for its use over a fixed period. Ownership risks such as total loss or major defects stay with the lessor, while the lessee pays for normal use.

Ijara rules that conventional leases often break

Scholars object when rent is calculated as interest on the car price, when late payments accrue interest, or when the lessee must guarantee the residual value. A lease ending in ownership is acceptable only if the final transfer is a separate sale or gift.

How German law classifies leasing

German law knows no ijara contract, so any lease is an ordinary rental-type contract under the BGB. Under § 506 BGB, consumer-credit rules apply when the lessee must buy the car, can be required to buy it, or guarantees a fixed residual value.

In a typical private lease the lessee is registered as keeper and pays vehicle tax and insurance; VAT is included in each monthly rate. In a car subscription, tax and insurance are usually built into the rate and handled by the provider.

Mileage leasing versus residual-value leasing

With Kilometerleasing the lessor keeps the residual-value risk and charges only for excess mileage and damage, which is closer to ijara. With Restwertleasing the customer guarantees the car’s final value, shifting ownership risk in a way most scholars reject.

What the Federal Court of Justice decided

In February 2021 the Bundesgerichtshof ruled in case VIII ZR 36/20 that a mileage lease is not a paid financing aid. Consumers therefore cannot rely on the consumer-credit withdrawal right, so leases must be checked carefully before signing.

Who offers what in the German market?

No German bank or leasing company sells a certified ijara car lease to private customers. KT Bank AG, the only Islamic bank, offers vehicle purchase finance rather than leasing, and conventional captive lessors such as manufacturers’ banks calculate rates with interest components.

Car subscriptions as the closest rental model

Subscription providers such as FINN rent cars from six months upwards for a single monthly rate covering insurance, vehicle tax, maintenance and tyres. Ownership and depreciation stay with the provider, which resembles an operating ijara, although insurance remains conventional and the product is not Sharia-certified.

Steps to a car without interest-based leasing

Because no certified lease exists, the practical path combines Sharia screening with German consumer checks. The sequence below works for both subscription and purchase routes.

  1. Decide whether you need ownership or only use of a car for a limited period.
  2. For use only, compare subscriptions and mileage leases, asking how rates and late fees are calculated.
  3. Reject offers with a residual-value guarantee or interest-based arrears charges.
  4. For ownership, request a KT Bank vehicle finance quote with a final instalment to mimic leasing payments.
  5. Check your Schufa data and gather payslips and bank statements for the credit check.
  6. Read the contract for deductibles, excess-mileage charges and damage assessment at return.
  7. Sign only after comparing total cost over the full term with a cash purchase.

Costs and documents to expect

Leasing and subscription offers bundle different items, so a line-by-line comparison is essential. The figures below come from providers’ published conditions or German tax law.

Mistakes that make a lease non-compliant

Many Muslims sign a German lease assuming it is automatically a rental in the Sharia sense. The following points are the most common traps in practice and are easily overlooked.

Leasing compared with Islamic purchase finance

For drivers who want to keep a car beyond three or four years, KT Bank’s FahrzeugFinanzierung is usually the cleaner option: a disclosed markup, ownership from the outset and an optional final instalment that lowers monthly payments similar to a lease.

Is a conventional mileage lease halal?

Scholars differ. Some accept a mileage lease when the lessor bears ownership risk and the rent is fixed, treating the internal interest calculation as pricing only. Others reject it because rates are expressly built on interest and late-payment clauses add interest.

Can KT Bank arrange a lease?

Not for private customers. KT Bank’s private product range covers home, vehicle and consumer purchase finance, all based on buying and reselling the asset. Business clients have separate investment financing, which does not extend to private car leasing.

Is a car subscription cheaper than leasing?

Not necessarily. Subscriptions include insurance, tax and maintenance and allow short terms from six months, which raises the monthly price. Comparing the all-in subscription rate with a lease plus insurance, tax and servicing gives a fair picture.

Can an electric car be leased halal?

The same rules apply to electric cars. Buyers of Togg models can use KT Bank’s financing over up to 100 months as a purchase route, while subscription providers include electric models in their fleets under the same rental conditions.

A practical decision rule

Choose a subscription or mileage lease only when the lessor carries ownership risk and no interest-based arrears apply; otherwise prefer an Islamic purchase with a final instalment, or a well-maintained used car bought from savings.

Where to access these solutions

  • FINN – Auto-Abo — Conventional car subscription in Germany: all-inclusive monthly rental with insurance, tax and maintenance; not Sharia-certified, but closest to an operating lease.

  • KT Bank AG – Togg financing — Markup-based financing for Togg electric cars in Germany, up to 100 months, for buyers who want ownership rather than a lease.
